When is this form used?

This form is approved for use to respond to an application in family law and child support proceedings. For general federal law proceedings, use Response – General Federal Law (except for bankruptcy).

General information

A response must be filed and served within 28 days of service of the application or cross-claim to which it relates: see Subrule 4.03(2) of the Federal Circuit Court Rules 2001.

A response may:

  1. indicate consent to an order sought by the applicant, or
  2. ask the Court to make another order, or
  3. ask the Court to dismiss the application, or
  4. seek orders in a matter other than the matter set out in the application, or
  5. make a cross-claim against the applicant, or another party; see Subrule 4.04(1).

A response must precisely and briefly state any orders sought and the basis on which the orders are sought; see Subrule 4.04(2).
